Welcome to Standby! These Terms of Service (“Terms”) govern your use of the Standby mobile application (the “App”) operated by Kinetics Automation LLC (“we,” “us,” or “our”).
By downloading, installing, or using Standby, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. Description of Service
Standby provides:
- Real-time wait times for theme park attractions at Walt Disney World, Universal Orlando (including Epic Universe), Disneyland Resort, Tokyo Disney Resort, Disneyland Paris, and other supported parks
- Push notification alerts when wait times drop below thresholds you set
- Line-Snipe alerts (Premium) to notify you when attractions reopen after downtime
- Show-time reminders for scheduled entertainment
- Live Activities for real-time wait times on your Lock Screen
- Home Screen widgets to view wait times at a glance
- Siri Shortcuts to ask about wait times using voice commands
- Favorites to quickly access your preferred attractions
- Wearable support (Future) for Apple Watch and other wearable devices
- Trip planning tools (Future) for itinerary and touring recommendations
Wait time data is sourced from publicly available third-party data. We are not affiliated with any theme park.
2. Acceptance of Terms
By using Standby, you confirm that:
- You have read and understood these Terms
- You agree to be bound by these Terms
- You are using the App in compliance with all applicable laws
- If you are under 18, you have parental or guardian consent
How You Accept These Terms
You indicate your acceptance of these Terms through any of the following actions:
- Tapping “Agree” or similar acceptance button when presented
- Completing an in-app purchase (Trip Pass, Annual, or Lifetime)
- Using premium features after purchase
- Creating alerts or enabling Live Activities
- Continued use of the App after being notified of updated Terms
If You Do Not Agree: If you do not agree to these Terms, you must stop using the App and delete it from your device. Continued use constitutes acceptance.
Changes to Terms: We may update these Terms from time to time. For material changes, we will provide at least 30 days' notice via in-app notification. You will be asked to acknowledge material changes before continuing to use the App. If you do not agree to updated Terms, you must stop using the App.
3. Account and Device
Standby does not require user accounts. Instead:
- Your device is identified by a unique device token for push notifications
- Your alerts and preferences are associated with your device
- You are responsible for maintaining the security of your device
If you delete and reinstall the App, your alerts may be preserved through device migration, but this is not guaranteed.

Required Subscription Disclosures
For Annual Subscriptions (Auto-Renewable):
- Price: $14.99 USD per year
- Your subscription will automatically renew each year unless you cancel
- You will be charged within 24 hours before the end of your current subscription period
- To cancel: Open Settings > [Your Name] > Subscriptions > Standby, then tap “Cancel Subscription”
- Cancellation takes effect at the end of the current billing period
- You will retain premium access until the end of your paid period
For Trip Pass (Non-Renewing):
- Price: $4.99 USD (one-time)
- Premium access lasts exactly 14 days from purchase
- Your subscription will NOT automatically renew
- After expiration, your account reverts to the Free tier
- Alerts exceeding the Free tier limit will be paused (not deleted)
For Lifetime (One-Time Purchase):
- Price: $49.99 USD (one-time)
- Premium access is permanent with no expiration
- No recurring charges
- Premium status syncs across devices using the same Apple ID
Free Trial Terms (if applicable):
- If a free trial is offered, the trial period will be clearly stated before purchase
- Any unused portion of a free trial is forfeited when you purchase a subscription
- You may cancel during the trial period without being charged
Auto-Renewable Subscriptions (Annual)
- Payment is charged to your Apple ID account at confirmation of purchase
- Subscription automatically renews unless canceled at least 24 hours before the end of the current period
- Your account will be charged for renewal within 24 hours prior to the end of the current period
- You can manage and cancel subscriptions in your Account Settings on the App Store after purchase
- Any unused portion of a free trial period will be forfeited when you purchase a subscription
Non-Renewing Subscriptions (Trip Pass)
- Trip Pass provides premium features for 14 days from the date of purchase
- After expiration, your account reverts to the Free tier
- Alerts exceeding the Free tier limit will be paused (not deleted)
- You can re-enable paused alerts by purchasing another Trip Pass or upgrading to Annual or Lifetime
One-Time Purchases (Lifetime)
- Lifetime provides permanent access to premium features with a single purchase
- Premium status syncs across devices using the same Apple ID
- No recurring charges or expiration
Refunds
We do not process refunds directly. All purchases are made through Apple and are subject to Apple's refund policies.
To request a refund from Apple:
- Visit reportaproblem.apple.com
- Sign in with your Apple ID
- Find the Standby purchase in your purchase history
- Select “Request a refund” and follow the prompts
Alternatively:
- Open the App Store app on your device
- Tap your profile picture > Purchase History
- Find the transaction and tap “Report a Problem”
Refund Policy Notes:
- Refund decisions are made solely by Apple
- We cannot guarantee Apple will approve any refund request
- Partial refunds for unused subscription time are at Apple's discretion
- Lifetime purchases are generally non-refundable after use
To Cancel Future Charges:
- Go to Settings > [Your Name] > Subscriptions > Standby
- Tap “Cancel Subscription” to prevent future renewal charges
5. Acceptable Use
You agree NOT to:
- Use the App for any unlawful purpose
- Attempt to reverse engineer, decompile, or disassemble the App
- Scrape, harvest, or collect data from the App by automated means
- Interfere with or disrupt the App's servers or networks
- Circumvent any security measures or access controls
- Impersonate any person or entity
- Use the App for commercial purposes without authorization
- Share or redistribute premium features without purchase
Wearable Device Acceptable Use (Future)
When wearable features become available, you additionally agree NOT to:
- Use wearable features to record other guests without their consent
- Violate any theme park's policies regarding wearable devices or recording equipment
- Use wearable features in areas where electronic devices are prohibited
- Stream or broadcast wait time information commercially without authorization
Violation of these terms may result in termination of your access.
6. Intellectual Property
Our Property
Kinetics Automation LLC owns all rights to:
- The Standby app name, logo, and branding
- App design, code, and user interface
- Documentation and content we create
Third-Party Property and Trademark Disclaimer
STANDBY IS NOT AFFILIATED WITH, ENDORSED BY, SPONSORED BY, OR IN ANY WAY OFFICIALLY CONNECTED WITH:
- The Walt Disney Company or Walt Disney Parks and Resorts
- NBCUniversal or Universal Parks & Resorts
- Comcast Corporation
- SeaWorld Entertainment, Inc.
- Six Flags Entertainment Corporation
- Cedar Fair Entertainment Company
- Merlin Entertainments Group
- Any other theme park owner, operator, or affiliate
Trademark Notice:
Theme park names, attraction names, character names, and related terminology are trademarks or registered trademarks of their respective owners, including but not limited to:
- Walt Disney World, Magic Kingdom, EPCOT, Disney's Hollywood Studios, Disney's Animal Kingdom, Disneyland, Disney California Adventure, and all related attraction names are trademarks of The Walt Disney Company
- Universal Studios, Universal Orlando Resort, Universal Studios Hollywood, Islands of Adventure, Epic Universe, and all related attraction names are trademarks of NBCUniversal

Nominative Fair Use:
We use these trademarks solely for the purpose of identifying the theme parks and attractions about which we provide wait time information. This constitutes nominative fair use under trademark law. We do not claim any ownership or affiliation with these marks.
Wait Time Data:
Wait time data is provided by third-party data sources. These data sources are independent services and are not affiliated with any theme park.
Your Rights
You retain ownership of any feedback or suggestions you provide, but grant us a license to use such feedback to improve the App.
7. Disclaimers
Wait Time Accuracy and Data Source Dependency
WAIT TIMES ARE PROVIDED FOR INFORMATIONAL PURPOSES ONLY.
Standby depends entirely on third-party data sources for wait time data. This dependency means:
- Service availability is contingent on the continued operation and availability of our third-party data sources
- Data accuracy depends on the data collection methods and sources used by these third parties
- Data freshness may vary; wait times may be delayed by several minutes from actual park conditions
- Coverage gaps may exist for certain attractions, parks, or time periods
We make NO guarantees regarding:
- The accuracy, completeness, timeliness, or reliability of wait time data
- The continued availability of wait time data from any source
- The consistency of data across different attractions or parks
- The availability of our service at any particular time
Reasons for Data Inaccuracy:
- Delays in data transmission from park systems through third-party sources to our app
- Park systems not immediately reflecting queue changes
- Differences between standby, single rider, Lightning Lane, and virtual queue times
- Attractions transitioning between operational states
- Special events, seasonal overlays, or technical difficulties
- Third-party API outages, rate limits, or data quality issues
ALWAYS verify wait times at the park before making decisions. Do not rely solely on this App for trip planning or time-sensitive decisions.
No Affiliation
- Standby is an independent app and is NOT affiliated with, endorsed by, or sponsored by The Walt Disney Company, NBCUniversal, or any theme park operator
- Theme park names and attraction names are used for informational purposes only under nominative fair use
- All trademarks belong to their respective owners
Service Availability
- We do not guarantee uninterrupted or error-free service
- The App depends on third-party APIs that may become unavailable without notice
- Features may change, be modified, or discontinued at any time
- Push notifications depend on network connectivity and iOS settings
AI-Powered Features Disclaimer (Future)
If we implement AI-powered or predictive features in the future:
- AI predictions are estimates only and may be inaccurate
- Past patterns do not guarantee future wait times
- AI-generated content will be clearly labeled
- Predictions should not be solely relied upon for planning
Wearable Device Disclaimer (Future)
If we implement wearable device support in the future:
- Wearable functionality depends on device compatibility and connectivity
- Wait time data on wearables may be delayed compared to the phone app
- Battery life and performance may vary by device
- Not all features may be available on all wearable devices
Trip Planning Disclaimer (Future)
If we implement trip planning features in the future:
- Itinerary suggestions are recommendations only
- Actual park conditions may differ from planning assumptions
- We are not responsible for trip outcomes based on our recommendations
- Always have backup plans for park visits
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- We are NOT liable for any indirect, incidental, special, consequential, or punitive damages
- We are NOT liable for damages arising from:
- Inaccurate or delayed wait times
- Missed or failed push notifications
- Decisions made based on App information
- Service interruptions or API failures
- Lost data or device issues
- Our total liability is limited to the amount you paid for the App (maximum $49.99)
Some jurisdictions do not allow limitation of liability for certain damages. In such cases, our liability is limited to the minimum extent permitted by law.
9. Indemnification
You agree to indemnify and hold harmless Kinetics Automation LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any third-party rights
- Any content you submit or share
10. Termination
By You
You may stop using Standby at any time by:
- Deleting the App from your device
- Disabling push notifications
- Requesting deletion of your data
By Us
We may terminate or suspend your access to the App at any time, without notice, for:
- Violation of these Terms
- Abusive or fraudulent behavior
- Technical or security reasons
- Discontinuation of service
Upon termination, your right to use the App ceases immediately.
11. Dispute Resolution
Informal Resolution
Before filing any formal dispute, you agree to contact us at support@joinstandby.com and attempt to resolve the dispute informally for at least 30 days.
IMPORTANT NOTICE FOR EU/EEA/UK RESIDENTS
The arbitration provisions in this Section 11 do NOT apply to you if you are a resident of the European Union, European Economic Area, or United Kingdom. If you are an EU/EEA/UK resident:
- You retain all rights to bring claims in your local courts
- You may use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr
- Nothing in these Terms limits your rights under applicable consumer protection laws
- Any disputes will be governed by the laws of your country of residence
Binding Arbitration (Non-EU/EEA/UK Users Only)
If you are NOT a resident of the EU, EEA, or UK, and we cannot resolve the dispute informally, you and Kinetics Automation LLC agree to resolve any disputes through binding arbitration rather than in court, except for:
- Small claims court actions within jurisdictional limits
- Injunctive relief for intellectual property violations
Delegation Clause: Any dispute about the enforceability, scope, or applicability of this arbitration agreement (including whether a particular claim is subject to arbitration) shall be decided by the arbitrator, not a court.
Arbitration Terms:
- Arbitration will be conducted by a neutral arbitrator under the rules of the American Arbitration Association (AAA) Consumer Arbitration Rules
- Arbitration will take place in Florida or via telephone/video at your choice
- Each party bears their own costs; arbitrator fees are shared equally unless the arbitrator determines otherwise
- The arbitrator's decision is final and binding
- Discovery is limited to what is necessary and relevant to the dispute
Mass Arbitration Provision
If 25 or more similar arbitration demands are filed against us within a 60-day period:
- Claims will be grouped into batches of no more than 50
- Each batch will be arbitrated sequentially
- Filing fees will be paid in accordance with AAA Mass Arbitration rules
- This provision does not waive any party's right to arbitration
Class Action Waiver
YOU AGREE TO RESOLVE DISPUTES ONLY ON AN INDIVIDUAL BASIS AND WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.
This class action waiver is a material term of this agreement. If a court finds that this waiver is unenforceable as to a particular claim, that claim (and only that claim) shall be severed from arbitration and may proceed in court, while all other claims remain subject to arbitration.
Opt-Out Right
You may opt out of this arbitration agreement by sending written notice to support@joinstandby.com within 30 days of first downloading the App. Your notice must include your name, device identifier (available in Settings), and a clear statement that you wish to opt out of arbitration.
12. Governing Law
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles.
For EU/EEA/UK residents, mandatory consumer protection laws of your country of residence will apply where required.
Any legal action not subject to arbitration shall be brought exclusively in the state or federal courts located in Florida.
13. Changes to Terms
We may modify these Terms at any time. Changes will be posted with an updated “Last Updated” date.
For material changes, we will provide at least 30 days' notice via in-app notification before the changes take effect. You will be asked to acknowledge material changes before continuing to use the App.
For non-material changes, we may notify you through:
- An in-app notice
- A push notification (if enabled)
Your continued use of Standby after changes take effect constitutes acceptance of the new Terms. If you do not agree with the changes, stop using the App.
14. Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
15. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Kinetics Automation LLC regarding the use of Standby.

17. Apple App Store Terms
The following additional terms apply to your use of Standby obtained through the Apple App Store. These terms are required by Apple and supplement the Terms above.
1. Scope of License
The license granted to you for Standby is limited to a non-transferable license to use the App on any Apple-branded device that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
2. Agreement Parties
You acknowledge that these Terms are between you and Kinetics Automation LLC only, and not with Apple Inc. (“Apple”). Kinetics Automation LLC, not Apple, is solely responsible for Standby and its content.
3. Maintenance and Support
Kinetics Automation LLC is solely responsible for providing any maintenance and support services for Standby, as specified in these Terms or as required under applicable law. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to Standby.
4. Warranty
Kinetics Automation LLC is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of Standby to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to Standby, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are Kinetics Automation LLC's sole responsibility.
5. Product Claims
You acknowledge that Kinetics Automation LLC, not Apple, is responsible for addressing any claims you or any third party may have relating to Standby or your possession and/or use of Standby, including but not limited to:
- Product liability claims
- Any claim that Standby fails to conform to any applicable legal or regulatory requirement
- Claims arising under consumer protection, privacy, or similar legislation, including in connection with Standby's use of HealthKit and HomeKit frameworks (if applicable)
6. Intellectual Property Claims
In the event of any third-party claim that Standby or your possession and use of Standby infringes that third party's intellectual property rights, Kinetics Automation LLC, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
7. Legal Compliance
You represent and warrant that:
- You are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country
- You are not listed on any U.S. Government list of prohibited or restricted parties
- You will comply with all applicable export and re-export restrictions

9. Third-Party Terms
You agree to comply with any applicable third-party terms when using Standby. This includes the terms of service of our third-party data sources and any applicable Apple terms.
10. Third-Party Beneficiary
You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
18. Accessibility
We are committed to making Standby accessible to all users. Our app supports:
- Dynamic Type: Text scales with your iOS accessibility settings
- VoiceOver: Full support for Apple's screen reader
- Reduced Motion: Respects system preferences for reduced animations
- High Contrast: Interface adapts to increased contrast settings
- Bold Text: Supports system bold text preference
